1. General Provisions

These Terms of Use ("Terms") govern your access to and use of the LoadPlan web application ("Service") operated by LoadPlan, located in Vilnius, Lithuania ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

2. Service Description

LoadPlan is a web-based truck load planning tool that provides 3D cargo visualization, automatic load optimization, LDM calculations, and PDF loading plan generation. The Service is provided "as is" and is intended as a planning aid — not as a substitute for professional judgment regarding cargo safety and compliance.

3. Account Registration

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Free Trial and Subscription

New users receive a 1-month free trial with full access to all features. After the trial period, continued access requires a paid subscription (monthly or yearly). Subscription fees are billed in advance and are non-refundable except as required by applicable law. You may cancel your subscription at any time through your account settings.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Reverse engineer, decompile, or disassemble the Service
Use the Service to transmit malicious code or interfere with its operation
Resell or redistribute the Service without written permission
Use automated tools to scrape or extract data from the Service

6. Intellectual Property

The Service, including its algorithms, design, graphics, and software, is the intellectual property of LoadPlan and is protected by copyright and other intellectual property laws. Your loading plans and cargo data remain your property.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. LoadPlan does not warrant that the load calculations, packing algorithms, or weight distributions are error-free or suitable for any particular purpose. Users are responsible for verifying all load plans against applicable regulations, vehicle specifications, and safety requirements before actual loading operations.

8. Limitation of Liability

To the maximum extent permitted by law, LoadPlan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, cargo damage, vehicle damage, personal injury, or fines arising from the use of or reliance on the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

9. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Vilnius, Lithuania.
